General Agreement
This agreement is made between Eagle View Solutions Inc., which is a Canadian incorporated company (which owns Testing4Success.com) and The Buyer[person or persons who have purchased the Website/App Health Check Service]. In consideration of The Buyer retaining Eagle View Solutions Inc. to conduct an independent service for website/app testing, it is agreed as follows:
Defects Liability
Eagle View Solutions Inc. will not be held responsible for any defects found present in the tested website/app after the agreed testing has been performed by Eagle View Solutions Inc. Eagle View Solutions Inc. will not be liable for any damages arising from the website/app product’s use. It is agreed that testing by its nature does not guarantee that the website/app under test will be free from defects after the testing has been performed.
Time Detail
As soon as payment is received, we will contact you to get the URL of the website to be tested. Once received, we will start testing right-away. Any delays greater than one day (due to illness etc.) to the completion of the agreed testing services will be made known to allow time extensions or alternative workarounds.
Source Files and Copyrights
The Buyer will retain all source files including their copyrights.
Payments/Refunds
Payment with be made via PayPal. Testing will not begin until payment has been received. Refunds will only be provided if there is a valid reason why testing cannot be started on the provided website/app to be tested. Once testing has started, a refund cannot be provided.
Confidentiality
This Agreement creates a confidential relationship between Eagle View Solutions Inc. and The Buyer. Information concerning Eagle View Solutions Inc.’s and/or The Buyer's business affairs, vendors, finances, properties, methods of operation, computer programs, employees, documentation, and other such information whether written, oral, or otherwise, is confidential in nature. Eagle View Solutions Inc., The Buyer and employees of both will adhere fully to this confidentiality agreement.
Governing law
This agreement shall be binding upon the heirs and assigns of the parties and shall be governed by and interpreted according to the laws of Canada.
